Murder is a serious criminal offense. According to California Penal Code 187, murder is defined as the unlawful killing of one human being, by another, with malice aforethought. It is important to note that the malice does not need to be expressed, it may be implied as well. An individual found guilty of first degree murder in the state of California will be facing 25 years to life, imprisonment without the possibility of parole, or the death penalty.
An individual found guilty of second degree murder faces a minimum of 15 years to life in prison. There are various circumstances which could increase those penalties, such as if the second degree murder was of a peace officer the penalties could range between 25 years to life, and life in prison without the possibility of parole. An individual who fires a weapon from inside a motor vehicle, with the intention of inflicting great bodily harm towards a person outside the vehicle, will be facing 20 years to life.
